Abstract

This article provides a comprehensive analysis of contemporary directions in the development of the theoretical foundations of civil procedural law, drawing on Azerbaijani law, Russian and Turkish procedural scholarship, and English-language approaches to access to justice, procedural justice, proportionality, case management, and digital justice. The central thesis is that improving the theoretical foundations of civil procedure should not be limited to updating the content of classical principles; rather, it should encompass the transformation of the traditional model of civil proceedings in light of the functional and technological requirements of modern justice. The study uses formal-legal, comparative-legal, systemic, functional, and doctrinal methods. It comparatively evaluates constitutional guarantees of judicial protection, reasonable time, the right to be heard, equality of arms, and adversarial proceedings, together with the Civil Procedure Code and the jurisprudence of the Constitutional Court and Supreme Court of Azerbaijan. The article argues that proportionality, procedural cooperation, active case management, procedural efficiency, legal certainty, and digital inclusion should function as key principles of modern civil procedure. It also examines risks created by digital courts and artificial intelligence. The study concludes by proposing a three-level model consisting of fundamental procedural guarantees, functional management principles, and new procedural safeguards for the digital era.
